These Terms and Conditions govern access to the Photera Imaging website and the purchase or use of our remote photo processing and digital image editing services. By approving a quote, providing files for paid work, or otherwise confirming an order, the client agrees to these Terms together with the applicable written scope, estimate, or order confirmation.

1. Services and Scope

Services may include enhancement, color correction, professional retouching, background work, product photo editing, optimization, batch processing, and advanced image editing. The exact deliverables, quantity, source format, output format, technical requirements, delivery schedule, included revision rounds, and price are defined in the applicable project confirmation. Website price ranges are general starting guidance and are not binding quotations.

2. Estimates and Project Approval

An estimate is based on the information and sample files available at the time it is prepared. Material differences in image quantity, complexity, source quality, masking requirements, compositing, turnaround, or output variants may require a revised estimate. Work begins after scope, price, and required payment arrangements are confirmed. A client representative approving a project confirms that they are authorized to do so.

3. Client Responsibilities

The client must provide usable source files, complete instructions, reliable references, accurate contact and billing details, and timely feedback. The client is responsible for retaining original source files and for reviewing delivered files before publication, printing, distribution, or other use. Delays in files, decisions, access, or feedback may shift the delivery schedule.

4. Rights in Submitted Materials

The client retains rights it lawfully holds in submitted materials and grants Photera Imaging a limited license to copy, process, store, and transmit those materials solely as reasonably necessary to perform the project and administer the relationship. The client represents that it owns or has sufficient permission to submit each image, reference, logo, instruction, and other material, and that the requested use will not violate third-party rights, privacy, publicity, confidentiality, or applicable law.

5. Creative and Technical Limitations

Results depend on the quality, resolution, focus, compression, dynamic range, and content of the source material. We do not guarantee that missing detail can be reconstructed, that every artifact can be removed, or that color will appear identical on uncalibrated displays, different browsers, consumer printers, or materials. We may decline unlawful, deceptive, abusive, infringing, or technically unsuitable work.

6. Revisions

Included revisions, if any, apply only to changes within the approved scope. A revision request should identify the affected file and requested adjustment clearly. New creative direction, replacement source files, additional images, new compositions, expanded cleanup, or requests made after approval may be quoted separately. Failure to provide feedback within a reasonable requested period may be treated as acceptance for scheduling and project closure purposes.

7. Fees and Payment

Fees, deposits, milestones, taxes, currency, and due dates are stated in the applicable confirmation or invoice. Unless otherwise agreed, final files may be withheld until amounts due are paid. The client is responsible for accurate billing details and any transaction charges imposed by its provider. Overdue amounts may pause active work and future bookings to the extent permitted by law.

8. Delivery and Acceptance

Delivery dates are good-faith estimates unless expressly identified in writing as fixed. Delivery is completed when files or access instructions are made available through the agreed channel. The client should inspect promptly for missing files or clear processing errors and report them with sufficient detail. Requests concerning cancellation or complaints are also governed by the Cancellation and Complaints Policy.

9. Confidentiality

Each party should protect non-public project and business information received from the other and use it only for the relationship. This obligation does not cover information that is public without breach, already lawfully known, independently developed, properly received from another source, or required to be disclosed by law.

10. Liability

To the maximum extent permitted by law, Photera Imaging is not liable for indirect, incidental, special, punitive, or consequential loss, including lost profits, missed publication opportunities, or loss arising from client misuse, inaccurate instructions, third-party platforms, or failure to retain source files. Our aggregate liability relating to a project will not exceed the fees paid for the specific services giving rise to the claim. Nothing here excludes liability that cannot legally be excluded.

11. Governing Terms and Changes

If a project confirmation conflicts with these Terms, the project confirmation controls for that project. Invalid provisions will be limited or removed without affecting the remainder. No waiver is continuing unless stated in writing. We may update these Terms prospectively; the version accepted for an existing confirmed project generally continues to govern that project unless the parties agree otherwise.
